Succession and Assignment of Tenancies

In certain circumstances a member of your family may have a right to your tenancy when you die, this is known as succession.

This could happen if they were:

  • your husband or wife and they were living with you at the time you died
  • your partner and you lived together for at least 12 months before your death
  • another close family member who has lived with you for at least 12 months leading up to your death.

In some cases the current property is not suitable for the successor.  If this happens we will find them another property.  A succession of tenancy can take place only once.  If a succession does take place the succeeding tenant will have the same rights.

Can I give my tenancy to someone else?

In certain circumstances assured tenants may be able to transfer the tenancy to another person or become joint tenants with another person.  This is known as assignment.

People who would qualify for an assignment are over 18 years of age and are members of the tenant's family or partner, who live at the property as their only or main home and have been living at the property for at least 12 months.

The other ways that a tenancy can be assigned to another person are when:

  • you are exchanging with someone
  • A Court Order has been granted following a relationship breakdown
